A response to this, by Adam Liptak from today’s NY Times front-page:
Mr. Liptak outlines the problem of “Formal versus Dynamic Equality” well but skirts the answer that everyone knows.
Equality is just equality. A Black, Latino, & White person should all have the same rights & opportunities under the law.
Rather than try to define who gets what, let’s reverse the though process.
Everyone gets everything. Anyone who tries to take anything away from anyone else should be punished.
In other words, crack down on the bigotry and the nepotism. Hard. Make transparent admissions & hiring processes, and then strongly penalize any institution that discriminates.
Of course we’ll still have to define discrimination – but that’s easier than redefining equality every five years.
